The Site, which is operated by Zvikler Healing Research (UK) Ltd (the “Company”), the Empower Research Project (the “Program”), the services (the “Services”) and Membership Level (“Member Content”) offered at the Site are provided to you only on the terms and conditions described in these Terms of Use. BY USING THESE SITES OR SERVICES, OR OPERATING ANY OF OUR PRODUCTS, YOU AGREE TO BE BOUND BY ALL OF THE TERMS AND CONDITIONS SET FORTH BELOW AS IF YOU HAD SIGNED A WRITTEN AGREEMENT. Please review these Terms of Use carefully. If you do not agree to these terms, you should not use the Site, our Products, or any of the Services. The “Terms of Use” for this Site and our products and services may be revised at any time by the Company without any specific notice to you. The latest and most current version of the Terms of Use will be posted on this Site and available for your review at any time. Therefore it is your responsibility to review these Terms of Use often. The term “you” or “user” refers to all individuals and entities accessing this Site or using our products and services for any reason; a “Member” is someone who has registered with the Site in order to receive Products and or Services. Use of the Site and the Services is void where prohibited. These terms are in addition to any terms and conditions that may be described in literature that accompanies any products and or services past or present.

2. Lawful Use and Purpose
a. You shall use the Services for lawful purposes only. You shall not post or transmit through the Site any material that violates or infringes in any way upon the legally recognized rights of others, that is unlawful, threatening, abusive, defamatory, invasive of privacy or publicity rights, vulgar, that constitutes hate speech intended to insult any race, skin color, religion, sexual orientation or national origin, or otherwise encourages conduct that would constitute a criminal offence, gives rise to civil liability or otherwise violates any law, or that contains any computer viruses or computer programs that are intended to damage, detrimentally interfere with, or clandestinely intercept or expropriate any system data or information. Your use of the Program, Product and the Services are made available for your personal non-commercial use only. You may not use the Program to sell a product or service or to increase traffic to your website for commercial purposes, to market or perform any commercial solicitation, to become users, members or customers of other services. You may not “meta-search” the Site.

You are solely accountable for all User Content (as defined in the next sentence) that you upload, post, and email, transmit or otherwise make available on or through the Services (communally, "Post"). "User Content" means User-Posted content or information of any type or medium, including but not limited to: letters, emails or other messages; other forms of communication through the Services; personal User information; board posts; reader reviews; blogs, data, notes and testimonials; poll votes; images; audio or video files; and software. You may Post only User Content, which you own, have produced or which you have clear authorisation to Post. You acknowledge and agree that neither Zvikler Healing Research (UK) Ltd (the “Company”) nor the Empower Research Project does not endorse any User Content and is not responsible or liable for any User Content, even though it may be unlawful, harassing, libellous, privacy invading, abusive, threatening, harmful, vulgar, obscene, or otherwise objectionable, or may infringe upon the intellectual property or other rights of another. You acknowledge that neither Zvikler Healing Research (UK) Ltd (the “Company”) nor the Empower Research Project does not pre-screen User Content, and has no obligation to do so, but that Zvikler Healing Research (UK) Ltd (the “Company”), the Empower Research Project and its designees will have the right (but not the obligation) in their sole discretion to refuse, edit, move or remove any User Content that is posted on or through the Service.

3. Ownership
Unless otherwise specifically stated, all content, without restriction, all images, designs, illustrations, icons, video clips, photographs, software, written and other materials including all products, that are part of the Empower Research Project or Membership Level Content, including, without limitation, the Services and all content, are protected by copyright, trademarks, patent rights, and/or other intellectual properties owned by or licensed to the Company. You own no right, title or interest in any downloaded content or software as a result of any such copying. You agree that you will not alter or remove any copyright notice or proprietary information contained within the Site. Additional products and company names mentioned on the Site may be trademarks of their respective owners. You agree not to use any means or process to keep an eye on content available through the Site without our explicit written permission. You agree not to obtain or attempt to obtain any source code, source files or construction of all or any part of the Site contents by any means whatsoever. Additionally, you may not use the Site in a way that breaches any international or regional and/or international laws. All products used as part of the Empower Research Project by its members, distributors, practitioners, demonstrators and/or associates remain the property of the company and are on indefinite loan to the member, distributor, practitioner, demonstrator and/or associate. Should the member, distributor, practitioner, demonstrator and/or associate breach this agreement on any level, the company is entitled to request that all products and/or materials are returned. Should a breach occur after the 3o-day money back period, the company is entitled to have any products or materials returned within 14-days. No refunds or money shall ever be paid to any member, distributor, practitioner, demonstrator and/or associate who breaches any aspect of this agreement.

4. Returns
All products being returned within the 30-day money back period, must be returned by recorded or special delivery and be adequately insured. All products and/or materials being returned must be packaged so as to fully protect the contents. Any returns arriving in a damaged condition will incur a surcharge that reflects the damage and resale usability of the product - all such surcharges will be at the discretion of the company. 5. 30-day Money Back Period
All our products, except for (Unlock Your Inner Power) come with a 30-day money back guarantee excluding Postage and Packing. Please see Returns above.

6. Refunds
Should you return a product within the 30-day money back period we will endeavour to refund your credit card within 7 days of receipt excluding postage and packing. Please note that this may not always be possible due to holidays or busy periods however we will do our best to organise your refund as soon as possible.

7. Payments
When purchasing one of our products and/or services, payments are made through PayPal and we do not hold any of your credit card details on our Site. After a payment is made you will be directed to create a username and password.

8. Password
You will access your account through the Site by means of a protected Login ID/Password that you will select. It is your responsibility to guard this information and keep it confidential. Therefore, you authorise the Company to treat any resulting transactions, obligations or liabilities as if you used the Services and the system yourself.

9. Membership to Empower Research Project
Due to the subjective nature of self-healing and self-communication, and in order to establish the authenticity of Empower Products and/or Services as well as the “potential benefits”, defined in this context in a purely anecdotal capacity, all users of our products and/or services agree to become members of the Empower Research Project with the explicit understanding that they are taking part in a research program where no claims are being made or implied. Users of our products agree and understand that they are totally responsible for all reactions and outcomes related to operating the system and/or using any of our products or services.  All members and/or users of any products and services understand that after the 28-day money back offer period elapses they may be asked to complete an online health questionnaire relating to that product and/or service. The completion of the questionnaire is purely voluntary, however regardless of whether it is completed or not, the user of any product and/or service is still subject to the terms and conditions herein.  Although every effort is made by us to keep your information confidential, the company does not warrant that your information is totally safe and secure from hackers, fraudulent and/or unlawful activity. 10. Modification Of Product, Membership & Website Terms & Conditions
The Company may from time to time change the terms and conditions and/or rules that govern your membership in the Empower Research Project (including, without limitation, your use of our Services) and/or use of the Site. This may include establishing new policies and/or limitations concerning your access to the Site and its contents. You agree that the Company shall not be liable to you or any third party for any amendments, suspension or discontinuance of any of its Services, documentation, information or other content on the Site. You agree and understand that the content of the site is being provided free and that should any interruption occur the company is not liable to provide any form of compensation to you or a third party. The company may periodically and without providing any notice make changes to the Site and/or substitute, delete and/or modify any aspect of its appearance and operation, without limitation. You acknowledge by your membership in the Empower Research Project and use of any product and/or services that all responses are self-initiated and that you operate all products and/or services related to the company entirely at your own risk. The company shall not be liable in any form whatsoever for any damages of any kind related to the use of this site and or any product or service supplied. Regardless of the form of action, whether in contract, or tort, the limitations of all liability and the exclusive remedy in all case shall be limited to a refund of the purchase price. The customer, member or user may request a refund of the purchase price excluding postage and packing for any product within the first 28 days from the date of purchase (excluding trial versions). The customer, member or user hereby acknowledges and accepts that after the 28-day money back period has elapsed they will no longer be entitled to any form of refund. The customer, member or user is entitled to a refund within the first 28 days from the date of purchase for each and every product based on the date of purchase.

b. Live Courses, Limitation Of Liability:
Should any live course be cancelled for any reason by the company, the company will issue a full refund of the purchase price of the course. In such circumstances the company shall not be held liable for any damages or consequential losses incurred by the customer, in out of pocket travel expenses and/or any other costs that may be incurred. The customer, member or user hereby acknowledges and accepts that after attending a course they will no longer be entitled to any form of refund.

12. Indemnification
You agree to defend, indemnify and hold the Company and the Empower Research Project, its subsidiaries, affiliates, successors and assignees, and their respective shareholders, directors, officers, employees and agents harmless from and against any and all claims, damages, costs and expenses, including legal fees, arising from or relating to your improper use or receipt of the Program, the Services, or otherwise in connection with EmpowerDisc.com, Empowerdisc.co.uk, the Site, the Empower Research Project, or any violation by you of this Agreement including, without limitation, any errors, inaccuracies, misrepresentations or defects in any materials or information submitted by you.

13. User Information.
When you register for the Site or the Empower Research Project, you will be asked to provide the Company with certain information including, without limitation, a valid email address (your “Information”). You represent and warrant that all information provided by you is genuine and accurate. In addition to the terms and conditions that may be set forth in any privacy policy on this Site, you understand and agree that the Company may disclose to third parties, on an anonymous aggregate basis, certain demographic or other non-personally identifiable information contained in your registration application. We reserve the right, and you authorise us by using our Site, to use and assign all information regarding Site uses by you and all information provided by you in any manner consistent with our Privacy Policy. Our Privacy Policy, as it may change from time to time, is a part of the Terms of Use.

14. Complete Agreement
This Agreement and any rules, policies or guidelines posted on the Site, including the Privacy Policy, constitute the entire agreement between the Company and you, with respect to the subject matter herein. In the event of any conflict between this Agreement and any information posted on the Site, this Agreement shall govern.

15. Enforcement Of this Agreement
If any prerequisite of this Agreement shall be deemed illegal or unenforceable, such illegality or unenforceability shall not affect the validity and enforceability of any other legal provision hereof, which together shall then be construed as if such illegal and unenforceable provision or provisions had not been inserted herein, unless such illegality or unenforceability shall destroy the underlying business purpose of this Agreement.

16. Mediation
Any claim, dispute or controversy, whether in contract, tort, pursuant in law or regulation or otherwise, and whether pre-existing, present or future, arising out of or relating to this Agreement, will be referred to and determined by arbitration to the exclusion of the courts. You agree to waive any right you may have to commence or participate in any class action against us related to any claim and, where applicable, you also agree to opt out of any class action proceeding against us. Should you believe that you have a claim, you must give written notice to the company of your intention to mediate, and similarly, the Empower Research Project will do the same with you. The mediation shall be applicable to the laws and rules relating to commercial arbitration in the United Kingdom.

17. Offers that include more than one Empower Disc on same membership
When purchasing an Empower Disc Membership you will have the option to get extra Empower Disc's at a discounted rate, on the same membership login details. This option is designed for people in the same household, and all users are accepting the above by selecting this option. Please note that with this option (multiple discs on the same membership) you will only receive one free bonus offer if applicable with your order.

18. Offers that include more than one Empower Disc for friends and family
When purchasing additional Empower Discs and or other products and services for family members or friends, the purchaser is responsible for obtaining confirmation that the new user accepts all the terms and conditions outlined on this page.

This Agreement is governed by and shall be construed in accordance with the laws of the United Kingdom. You agree and acknowledge that your use of any products and/or Services, the Empower Research Project and the Site shall be deemed to have occurred and taken place within the United Kingdom.
