Should a breach occur after the 3o-day money back period, the company is entitled to have any products or materials returned within 14-days. No refunds or money shall ever be paid to any member, distributor, practitioner, demonstrator and/or associate who breaches any aspect of this agreement.

4. Returns
All products being returned within the 30-day money back period, must be returned by recorded or special delivery and be adequately insured. 6. Refunds
Should you return a product within the 30-day money back period we will endeavour to refund your credit card within 7 days of receipt excluding postage and packing. Should any live course be cancelled for any reason by the company, the company will issue a full refund of the purchase price of the course. In such circumstances the company shall not be held liable for any damages or consequential losses incurred by the customer, in out of pocket travel expenses and/or any other costs that may be incurred. The customer, member or user hereby acknowledges and accepts that after attending a course they will no longer be entitled to any form of refund.

12. Indemnification
You agree to defend, indemnify and hold the Company and the Empower Research Project, its subsidiaries, affiliates, successors and assignees, and their respective shareholders, directors, officers, employees and agents harmless from and against any and all claims, damages, costs and expenses, including legal fees, arising from or relating to your improper use or receipt of the Program, the Services, or otherwise in connection with EmpowerDisc.com, Empowerdisc.co.uk, the Site, the Empower Research Project, or any violation by you of this Agreement including, without limitation, any errors, inaccuracies, misrepresentations or defects in any materials or information submitted by you.

13. User Information.
When you register for the Site or the Empower Research Project, you will be asked to provide the Company with certain information including, without limitation, a valid email address (your “Information”). You represent and warrant that all information provided by you is genuine and accurate. In addition to the terms and conditions that may be set forth in any privacy policy on this Site, you understand and agree that the Company may disclose to third parties, on an anonymous aggregate basis, certain demographic or other non-personally identifiable information contained in your registration application. We reserve the right, and you authorise us by using our Site, to use and assign all information regarding Site uses by you and all information provided by you in any manner consistent with our Privacy Policy. Our Privacy Policy, as it may change from time to time, is a part of the Terms of Use.

14. Complete Agreement
This Agreement and any rules, policies or guidelines posted on the Site, including the Privacy Policy, constitute the entire agreement between the Company and you, with respect to the subject matter herein. In the event of any conflict between this Agreement and any information posted on the Site, this Agreement shall govern.

15. Enforcement Of this Agreement
If any prerequisite of this Agreement shall be deemed illegal or unenforceable, such illegality or unenforceability shall not affect the validity and enforceability of any other legal provision hereof, which together shall then be construed as if such illegal and unenforceable provision or provisions had not been inserted herein, unless such illegality or unenforceability shall destroy the underlying business purpose of this Agreement.

16. Mediation
Any claim, dispute or controversy, whether in contract, tort, pursuant in law or regulation or otherwise, and whether pre-existing, present or future, arising out of or relating to this Agreement, will be referred to and determined by arbitration to the exclusion of the courts. You agree to waive any right you may have to commence or participate in any class action against us related to any claim and, where applicable, you also agree to opt out of any class action proceeding against us. Should you believe that you have a claim, you must give written notice to the company of your intention to mediate, and similarly, the Empower Research Project will do the same with you. The mediation shall be applicable to the laws and rules relating to commercial arbitration in the United Kingdom.

17. Offers that include more than one Empower Disc on same membership
When purchasing an Empower Disc Membership you will have the option to get extra Empower Disc's at a discounted rate, on the same membership login details. This option is designed for people in the same household, and all users are accepting the above by selecting this option.
